1. About the Academy

Elevate English Academy is an online English-language education and training academy operated by Mr. Sameer Dhamija, Founder & Lead Trainer, providing online courses, live classes, educational content and related learner support through its website and associated digital platforms.

2. Eligibility and Age Requirement

The Academy's paid courses, live classes and related paid educational services are presently offered only to persons who are 18 years of age or older.

By enrolling in a paid programme, you represent that you are at least 18 years old and that the information provided by you is accurate. The Academy may request reasonable age or identity verification where necessary for enrolment, payment, fraud prevention, refund processing or legal compliance.

The website may be viewed by persons below 18 years of age; however, paid enrolment is restricted as stated above unless the Academy formally changes its eligibility requirements in accordance with applicable law.

3. Nature and Scope of Services

The Academy may offer different educational formats, including recorded/self-paced courses, live cohort courses, one-to-one classes, workshops, short programmes, digital or downloadable materials and other educational services introduced from time to time.

The specific course description, curriculum, duration, schedule, delivery format, access period and other programme-specific information displayed at the time of purchase will form part of the applicable enrolment arrangement, subject to these Terms and the applicable Academy policies.

4. Account Registration and Learner Information

Where an account or registration is required, you must provide information that is accurate, complete and reasonably current. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.

You must promptly inform the Academy if you reasonably suspect unauthorised access to your account. The Academy may take reasonable steps to protect an account, including restricting access where necessary for security, fraud prevention or legal compliance.

5. Enrolment and Acceptance

An enrolment becomes effective when the Academy or its authorised payment/enrolment system confirms the relevant purchase or registration, subject to successful payment and any applicable verification.

The Academy may decline or cancel an enrolment where there is a reasonable basis to suspect fraud, unauthorised payment, identity misuse, material error, technical failure, or other circumstances requiring cancellation, subject always to applicable law and the learner's rights under the Refund & Cancellation Policy.

6. Course Access and Delivery

Course access may be provided through the Academy's website, Graphy platform, application or another platform authorised by the Academy. Access is personal to the enrolled Learner and is subject to the programme-specific access conditions communicated at or before purchase.

The Academy may make reasonable operational changes to the delivery method, platform, schedule, instructor or supporting arrangements where necessary, provided that the Academy addresses any material change in accordance with the applicable Refund & Cancellation Policy and applicable law.

Where access depends upon a third-party platform or technology service, availability may be affected by circumstances outside the Academy's reasonable control.

7. Live Classes, Attendance and Rescheduling

Where a programme includes live classes, the Learner is expected to attend according to the published schedule and follow reasonable instructions relating to class participation, conduct and technical requirements.

One-to-one cancellation and rescheduling requirements, including the applicable notice period, are governed by the Refund & Cancellation Policy.

The Academy may reschedule or replace a live class where reasonably necessary. Academy-side cancellation, postponement, material change or service disruption will be handled in accordance with the Refund & Cancellation Policy.

8. Class Recordings

Certain live classes may be recorded for educational, course-access, revision, administration, learner-support or internal quality-improvement purposes. Where a class is to be recorded, participants should be notified before recording begins.

Recordings may contain participant names, images, voices, video, questions, chat messages and other contributions made during the session. Where learner access to recordings is enabled, access will be provided through the applicable course or platform settings.

Identifiable learner participation, including name, image, voice, video or testimonial, will not be used for promotional or advertising purposes without separate and explicit consent where such consent is required.

9. Payments, Pricing and Taxes

Course and programme prices will be displayed through the Academy's website, Graphy checkout or other authorised payment/enrolment mechanism. You agree to pay the amount applicable to the selected programme at the time of purchase.

The Academy currently uses the Graphy Payment Gateway through its Graphy platform. Payment credentials such as complete card, UPI or banking credentials are processed by the relevant payment service provider and are not intended to be stored directly by the Academy.

As of the effective date of the Refund & Cancellation Policy, the Academy has confirmed that it is not presently registered under GST and its current Graphy checkout configuration reflects "No Tax". Tax treatment may change if the Academy becomes liable for or registers under an applicable tax regime.

The Academy does not currently provide its own instalment or EMI facility. If third-party EMI or instalment facilities are introduced, the relevant provider's terms may also apply.

10. Refunds, Cancellations, Transfers and Deferment

All refunds, cancellation rights, rescheduling arrangements, transfers, deferments, deductions, duplicate-payment refunds and Academy-side cancellation or material-change remedies are governed by the Academy's Refund & Cancellation Policy.

The Refund & Cancellation Policy forms an integral part of these Terms. If there is an inconsistency specifically concerning refund, cancellation, transfer, deferment or refund processing, the Refund & Cancellation Policy will govern those matters, subject to applicable law.

Nothing in these Terms or the Refund & Cancellation Policy excludes or restricts any mandatory statutory right or remedy available to a consumer.

11. Digital and Downloadable Materials

Where digital or downloadable educational materials are included in a programme, access is provided for the educational purpose and period applicable to the relevant programme.

Once a downloadable or digital material has been made available or downloaded, the applicable refund treatment will be governed by the Refund & Cancellation Policy and applicable law.

Learners must not redistribute, resell, publicly upload, commercially exploit or otherwise share Academy materials except where expressly authorised by the Academy or permitted by law.

12. Intellectual Property

Unless expressly stated otherwise, the Academy and/or its licensors retain intellectual-property rights in course content, videos, recordings, teaching materials, written materials, graphics, logos, trademarks, website content, training methodology and other materials supplied by the Academy.

Your enrolment grants you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the purchased educational content for your own lawful educational purposes during the applicable access period.

No ownership in Academy content is transferred to you by purchasing or accessing a course.

13. Permitted and Prohibited Use

You agree to use the Academy's services and content only for lawful purposes and in a manner consistent with these Terms.

• You must not share your account credentials or course access with another person.
• You must not copy, reproduce, distribute, resell, rent, sublicense or commercially exploit Academy content without written permission.
• You must not record, screen-capture, download or reproduce live classes or course content except where the Academy expressly permits such use or applicable law permits it.
• You must not upload or transmit malware, malicious code or material intended to interfere with the Academy's systems or other users.
• You must not attempt to bypass access controls, security measures, payment mechanisms or technical restrictions.
• You must not use the Academy's services to harass, threaten, impersonate, defame or unlawfully target the Academy, trainers, staff or other learners.
• You must not use Academy content to create or provide a competing commercial course or service where doing so infringes the Academy's intellectual-property rights.

14. Learner Conduct in Live and Interactive Sessions

Learners must behave respectfully during live classes, webinars, chats, WhatsApp communications and other interactive sessions. The Academy may take reasonable action where conduct materially disrupts teaching, threatens safety, violates another person's rights, or breaches these Terms.

The Academy may restrict participation or access where reasonably necessary to protect learners, trainers, systems or the integrity of the programme. Any such action will remain subject to applicable law and any refund or other remedy legally due.

15. Third-Party Platforms and Services

The Academy's services may involve third-party platforms and providers, including Graphy, payment service providers, communication services, hosting/technology providers and integrated or third-party video-conferencing services.

Third-party services may have their own terms, privacy policies, technical limitations and service availability. Your use of a third-party service may therefore also be subject to the applicable third party's terms.

The Academy does not control independent third-party services and is not responsible for matters solely attributable to a third party, subject to the Academy's obligations under applicable law.

16. Privacy and Personal Data

The Academy's collection, use, storage, disclosure and other processing of personal data is governed by its Privacy Policy, which forms an integral part of these Terms.

The Privacy Policy describes the categories of personal data processed, purposes of processing, class recordings, payment processing, third-party service providers, retention, security, rights and grievance mechanisms.

By using the Academy's services, you acknowledge that personal data may be processed as described in the Privacy Policy and in accordance with applicable law.

17. Marketing and Communications

The Academy may send transactional and service-related communications necessary for enrolment, payments, course access, class schedules, account administration, service changes, support and legal notices.

Promotional communications will be handled in accordance with the Privacy Policy and applicable consent requirements. You may opt out of promotional communications using an available unsubscribe mechanism or by contacting the Academy, without necessarily stopping essential service-related communications.

18. Accuracy of Information and Learner Responsibilities

You are responsible for providing accurate information required for enrolment, payment, communication and service delivery.

You should maintain appropriate internet connectivity, compatible devices, software and other technical arrangements required to access online services, unless the Academy expressly states otherwise.

The Academy is not responsible for problems caused solely by your device, internet connection, browser, software, local network or other equipment outside the Academy's reasonable control.

19. Educational Disclaimer

The Academy provides educational and training services. Course participation does not guarantee any particular examination result, employment outcome, promotion, admission, income, certification, fluency level or other individual result.

Learner outcomes may depend upon individual effort, attendance, prior knowledge, practice, external circumstances and other factors outside the Academy's control.

Any course description, trainer statement or educational guidance should be understood in the context of the educational service being provided and should not be treated as a guarantee of a particular outcome.

20. Service Availability and Force Majeure

The Academy will use reasonable efforts to provide its services as described, but uninterrupted availability cannot be guaranteed. Services may be affected by technical failures, internet or platform outages, power failures, natural events, government action, labour disruptions, emergencies, cyber incidents, payment-provider issues or other circumstances beyond the Academy's reasonable control.

Where such circumstances materially affect a contracted programme, the Academy will take reasonable remedial steps and, where applicable, provide the remedy required under the Refund & Cancellation Policy and applicable law.

21. Suspension or Termination of Access

The Academy may temporarily suspend or restrict access where reasonably necessary for security, fraud prevention, investigation of unauthorised activity, serious misuse, material breach of these Terms, or protection of the Academy, trainers or other learners.

Where suspension or termination occurs for a Learner's breach, the Academy may consider the circumstances when determining whether any refund, transfer or other remedy is available, subject to the Refund & Cancellation Policy and applicable law.

Nothing in this section authorises the Academy to withhold a refund or other remedy where applicable law requires otherwise.

22. Complaints and Grievance Redressal

For complaints or grievances concerning courses, access, payments, cancellations, refunds or services, the Learner may contact Mr. Sameer Dhamija, Grievance Officer, Elevate English Academy, at sameer@elevateenglishacademy.in or +91 98182 48493.

The Academy will endeavour to acknowledge a grievance within 48 hours and endeavour to resolve it within 15 working days, subject to the nature and complexity of the matter and receipt of information reasonably necessary for resolution.

These internal service targets do not restrict any shorter statutory period or legal remedy available to the Learner.

23. Consumer Rights and Applicable Law

These Terms are intended to operate consistently with applicable Indian law, including applicable consumer-protection and e-commerce requirements. Nothing in these Terms is intended to exclude, restrict or waive a mandatory statutory right or remedy.

The Academy will not rely on any provision of these Terms to impose an unreasonable or disproportionate charge, retain amounts for services not provided where a refund is legally due, or prevent a consumer from exercising a lawful remedy.

The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 apply to relevant online consumer transactions to the extent applicable. The Academy's policies are intended to be read consistently with those requirements.

24. Amendments to These Terms

The Academy may update these Terms from time to time to reflect changes in courses, services, technology, payment arrangements, operational practices or applicable legal requirements.

The version ordinarily applicable to a particular purchase will be the version in force at the time of that purchase, unless a later change is required by law or expressly made applicable to existing transactions.

The Academy will endeavour to publish the latest version of these Terms on its website and indicate the applicable effective or last-updated date.

25. Relationship with Privacy Policy and Refund & Cancellation Policy

These Terms should be read together with the Academy's Privacy Policy and Refund & Cancellation Policy.

The Privacy Policy governs the Academy's handling of personal data. The Refund & Cancellation Policy governs refund, cancellation, rescheduling, transfer, deferment and related payment remedies.

If there is an inconsistency specifically concerning refund, cancellation, transfer, deferment or refund processing, the Refund & Cancellation Policy will govern those matters, subject to applicable law. Nothing in these Terms limits rights or obligations arising under the Privacy Policy, Refund & Cancellation Policy or applicable law.

26. Severability

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where legally permissible. The remaining provisions will continue to operate to the extent permitted by law.

27. No Waiver

A failure or delay by the Academy in exercising any right or remedy under these Terms will not constitute a waiver of that right or remedy. Any waiver will be effective only to the extent expressly made by the Academy.

28. Governing Law and Legal Rights

These Terms shall be governed by and interpreted in accordance with the laws applicable in India.

Nothing in these Terms prevents a Learner from approaching any court, consumer commission, regulatory authority or other competent forum having jurisdiction under applicable law.
